Nolte House Fire: Damage and Minor Injuries...Or Not

Nick Nolte is down and out in the Malibu hills. Or is he?

There are conflicting reports about what actually happened at the actor's beach-adjacent homestead this morning around 11:30.

“When they [emergency responders] arrived, the house was fully involved,” Lt. Scott Chew of the Malibu/Lost Hills Sheriff Station tells E! News. “The occupant of the house, actor Nick Nolte, received a small cut on his right hand when he broke a window to escape the fire.”

The house was declared a total loss, and fire officials estimate the loss at $3.5 million, per Crew. L.A. County Fire Department Inspector Ron Harelson estimated structural damage in the amount of $1.5 million and tacked on another $1.5 million in personal property loss.

Fire department rep Frank Garrido told Us Weekly, meanwhile, that paramedics treated Nolte at the scene for cuts and minor smoke inhalation and that the Prince of Tides star is expected to be just fine.

But though officials are giving closely corresponding accounts of the incident, a rep for the 67-year-old actor put yet another spin on the story.

Britney Trial Passes Another Roadblock

OK, lawyers. Britney Spears has to face the music, you hear?

A three-judge panel has refused to throw out a year-old misdemeanor charge against the popster for driving with an invalid license, a case that's finally scheduled to go to trial Oct. 15 after months of legal wrangling on Spears' behalf.

No explanation was given in the one-page ruling, but the decision was unanimous. A pretrial hearing is set for Wednesday.

Spears' attorney Michael Flanagan filed a 51-page motion in Los Angeles Superior Court Sept. 29 to "immediately stay all proceedings" with the hope that the appellate judges would move to dismiss the charge, which Flanagan has disputed as an example of Spears' celebrity being used against her.

Rocco DiSpirito says it was not his choice to do a Viennese waltz to Tom Jones' camp classic "What's New Pussycat?" on last night's Dancing With the Stars.

"We were stymied by the song for about a day," DiSpirito tells me of the tune picked by producers. "But then we figured out how to channel our inner pussycats."

Unfortunately those inner pussycats only brought the chef and his partner Karina Smirnoff 20 points from the judges, nearly the lowest score. Kooky Cloris Leachman was once again on the bottom with just 16.

DWTS' Misty May Recovering After Achilles Surgery

Misty May-Treanor is on the rebound.

The Olympic beach volleyball champ and Dancing With the Stars contender is on the mend after going under the knife this morning to repair the Achilles tendon she tore while rehearsing the jive last Friday.

"Thanks for all your concern and well wishes for Misty," her rep tells E! News. "Misty had a successful surgery on her ruptured Achilles this morning.

"She is currently at home and recovering. Her husband Matt is with her."

The crutch-wielding May-Treanor, 31, announced her withdrawal from DWTS on last night's episode of the ABC reality competition.

Still no word whether last week's reject, Kim Kardashian, will return for another spin on the dance floor.

Clone Wars a Prime-Time Force

Star Wars: The Clone Wars premiered big. Friday Night Lights premiered…well… Anyway, it premiered. 

When The Clone Wars bowed in theaters in August, it was called a glorified TV pilot, and sure enough it brought glory to Cartoon Network—4 million viewers for Friday's back-to-back episodes, a new record for the cable network.

Friday Night Lights' third-season opener was watched by, um, 400,000, The New York Times reported, down, um, 6 million viewers from last fall's premiere. But don't punt the football yet: FNL is running exclusively right now on DirecTV, the subscription-only satellite system that helped save the series.

Possibly in need of saving soon: NBC's Heroes , which hit another new low last week (9.5 million) and was down again last night. So no one's watching, right? Not quite.

It's official!

Salma Hayek could be on the 30 Rock set as early as this week.

Her rep just confirmed to me that she will be shooting an upcoming appearance on the hit NBC series and it could be within the next few days.

Tina Fey asked Hayek to guest on the Emmy-winning series as "a character—not as herself" for two episodes, according to a report in the New York Post.

Hayek joins an almost daily growing list of celebs whom Fey has nabbed for 30 Rock, including Oprah Winfrey, Jennifer Aniston, Jerry Seinfeld and Al Gore.

Travis Barker Still in Recovery Mode

Travis Barker may have been released from Georgia's Joseph M. Still Burn Center last month, but his ongoing treatment is far from over.

E! News has confirmed that the plane crash survivor has been receiving care, including surgery, at a Los Angeles-area hospital.

A source says the former Blink-182 drummer remains in the facility and his condition has been "up and down" since he returned to Southern California.

The 32-year-old rocker was released Sept. 29 from the Augusta, Ga., hospital where he and Adam "DJ AM" Goldstein were taken in the immediate aftermath of the takeoff crash of a Learjet that left the other four people on board dead.

Barker suffered second- and third-degree burns in the Sept. 19 accident but, along with Goldstein, is expected to make a full recovery.
